TSGLI, or The Servicemembers’ Group Life Insurance Traumatic Injury Protection Insurance, provides financial assistance that helps service members recover from serious injuries. The coverage offered by TSGLI provides vitally needed assistance in covering bills after you suffer a traumatic brain injury, whether your injuries occur in the line of duty or due to outside reasons.
Unfortunately, some people may face benefit denial that can leave them struggling to take care of their bills or other care as they deal with the aftermath of a head injury. Others may find that, despite clear evidence of their injuries and their financial struggles, the insurance company does not offer the compensation they deserve.
If you find yourself dealing with a TSGLI claim denial after a serious injury during your military service, or you feel that you have not received an offer that reflects the compensation you really deserve for your injuries, you may need a lawyer. Contact Lucas, Macyszyn & Dyer Law Firm’s TSGLI injury lawyers today for a free consultation.
Lucas, Macyszyn & Dyer Law Firm Can Help with Your TSGLI Claim
As a service member, you have dealt with many sacrifices in the line of duty. Your injury may serve as the latest, most visible evidence of the time, effort, and service you and your family have given throughout your enlistment.
At Lucas, Macyszyn & Dyer Law Firm, we understand the commitment and sacrifice demanded of military families—and we understand your frustration when you do not receive the support and assistance you deserve following serious injuries suffered during that service.
We have a strong commitment to our service members and, indeed, all of our clients. Furthermore, we know how personal your TSGLI claim can grow when you do not receive the support you deserve.
We help determine whether you can recover TSGLI support for your head injury.
We will look at when your head injury occurred, how it occurred, and what losses you sustained from your injury to determine whether you have the right to a TSGLI claim and how much compensation you should expect for it.
At Lucas, Macyszyn & Dyer Law Firm, we understand the terms necessary to recover payment under TSGLI, including what standards you must meet and what losses you must have suffered.
We give you a chance to tell your story.
For many service members, having their story heard matters. You want to explain how your head injury occurred, why you deserve support, and how it has limited you. At Lucas, Macyszyn & Dyer Law Firm, we understand that each injured service member has his own story to tell, including the specific ways in which your injury may have impacted you. We want to give you a chance to tell your story, then offer the support you need to move forward with your TSGLI claim.
We support you as you pursue the compensation you deserve.
Dealing with the VA over insurance matters can prove incredibly frustrating. You know the standard of support you should expect, but the VA may not automatically offer the financial support or even medical service that you really deserve for your severe injuries.
Under TSGLI, you have the right to claim compensation when you suffered an injury as a service member, regardless of whether your injuries occurred while performing your normal job duties or another set of circumstances. We support our clients through every step of the process, including fighting for them when necessary to help them recover the maximum compensation they deserve for their injuries.
How Head Injuries Can Impact Your Life
Traumatic brain injury, also known as TBI, can have an immense impact on many areas of your life, including your ability to work normally as a service member. If you suffered a head injury, whether in performing your usual duty responsibilities or during leisure activities, you may file a claim under TSGLI to pay for the limitations you face.
Your doctor may work with you to help you understand the limitations you may face due to your injuries, which may vary based on the part of your brain injured in the accident and the severity of your injuries. Often, occupational therapy can help you learn how to cope with many of the limitations associated with those injuries, particularly if you have considerable losses in your memory, your ability to focus, or your emotional regulation.
Memory Loss
Often, if you watch popular media, you will see memory loss highlighted as the primary effect of a head injury. Most of the time, popular media focuses on the loss of long-term memories. However, in the case of a head injury, you may actually suffer more from short-term memory loss than you do from the loss of your long-term memories.
You know that you walked into a room for a reason, but cannot remember what it was. You just received instructions, including instructions from your spouse or a friend, but cannot recall them moments later. On your search for an item that you need to perform a common task, you may open the same cabinet repeatedly because you cannot remember which one you have already opened.
Frustration may mount quickly due to that loss of short-term memory, especially as it lingers over time. You typically cannot return to work while you deal with memory loss, especially if you typically work in a physically or mentally demanding profession, since it could pose a danger to you and everyone around you.
Trouble Focusing or Concentrating
Many people with brain injuries struggle with focus issues. You might, for example, know that you have a task to complete, or even that you have a limited amount of time to complete the task, but struggle to keep your attention locked on it. Even people who previously had laser-sharp focus may struggle when dealing with relatively common tasks following their injuries.
Worse, that lack of focus does not just extend to things you have to do, like filling out paperwork or taking care of a work task. The lack of focus and concentration can spill into other areas of your life, as well. You might have a hard time focusing on a video game you usually love to play or find yourself distracted while trying to talk with your spouse or play with your children. Combined with memory difficulties, that lack of focus can make it very difficult to engage in activities that you usually take for granted.
Sleep Disturbances
As a service member, you need to remain at the top of your game. Unfortunately, lack of sleep can quickly interfere with that, leading to a further deterioration of your mental capacity. Head injuries, however, often cause sleep disturbances.
While some people sleep more as the brain tries to repair itself, others may struggle to fall asleep at all. If you suffered from insomnia in the past, you may find that a head injury makes those struggles worse than ever, leaving you tired, disoriented, and frustrated throughout the rest of the day.
Emotional Regulation Challenges
Head injuries can cause immense problems with overall emotional regulation. Many people who have suffered traumatic brain injury discover just how hard maintaining emotional control can grow.
Some people suffer from mood swings, including greater irritability than normal or changes in emotion that seem to come out of nowhere. Others may react too harshly to what seems like relatively normal stimuli: rage over something that should cause only minor frustration, for example.
Patients with traumatic brain injury also frequently “mix up” emotions: instead of reacting with laughter to something amusing, for example, the patient becomes suddenly angry or shows signs of sadness. Often, patients may struggle to deal with and relate to others.
Personality Changes
In extreme cases, brain injuries can lead to permanent personality changes that may change the way you interact with everyone around you. A service member who previously seemed relatively slow to anger might suddenly fly off the handle much more easily, for example.
Some people find it harder to relate to friends and loved ones. Others discover that their likes and dislikes change, sometimes dramatically. These personality changes can make it hard to maintain relationships with loved ones. Sometimes, victims return to normal over time. Other times, however, the personality changes may remain permanently.
Physical Challenges
For some patients with head injuries, physical symptoms may emerge. Some people struggle with dizziness or vertigo. Others suffer from near-constant nausea. Still others suffer from headaches, ringing in the ears, or tunnel vision.
Symptoms of even mild traumatic brain injury can linger more than a year after the initial incident. Working with your doctor or therapists can make it easier to handle those changes in your capability and your life.
Do You Qualify for a TSGLI Claim Following Traumatic Brain Injury?
According to TSGLI standards, you may qualify for compensation if you:
- Went into a coma that interfered with at least two activities of daily living for 15 days or more following your traumatic brain injury
- Faced hospitalization for 15 days or more following traumatic brain injury
- Suffered your traumatic brain injury while serving in the Armed Forces
- Suffered a scheduled loss, outlined specifically on the VA benefit table, as a result of your traumatic brain injury
If you suffered a traumatic brain injury while serving in the Armed Forces, and you want to seek compensation for those injuries through TSGLI benefits, work closely with an attorney to get a better idea of the compensation you deserve.
In general, TSGLI insurance will entitle you to $25,000 in compensation for the first 15 days you spend in a coma or hospital from a traumatic brain injury, then $25,000 at 30, 60, and 90 days spent in the hospital. You can recover a maximum of $100,000 in benefits through TSGLI for one traumatic injury, and if you spend the first 15 days of your coma or injury in the hospital, that payment will replace the payment for the first 15 days in a coma.
An attorney can help break down the compensation you may deserve for a traumatic brain injury suffered during your time as a service member.
What Are the Odds of TSGLI Claim Denial?
TSGLI helps protect service members and their families any time the service member sustains a serious injury, regardless of whether it occurs in the line of duty. That vital compensation can help service members make up for some of the extra bills they and their family members may face and ease some of the financial strain they may have to contend with immediately following those injuries. However, the VA frequently denies TSGLI claims, especially claims related to head trauma or traumatic brain injury.
Having an attorney on your side can prove critical to pursuing the compensation you deserve for your injuries. As a service member, you make immense sacrifices for your country. In exchange, you expect support and aid when a serious injury occurs. TSGLI offers one vital layer of protection that can help many service members manage financial challenges.
Claim denial can leave your family struggling. At Lucas, Macyszyn & Dyer Law Firm, we support service members who sustained severe injuries and need to seek compensation for those losses through TSGLI claims, from correctly filling out your paperwork to helping you understand the benefits you deserve.
